While pharmaceuticals might logically be seen as fitting within a wider “health” field, EU-level activity reflects a distinction – and different dynamics – between the two. Notably, EU pharmaceutical policy comprises a legal framework which is characterised by greater moves towards harmonisation, motivated by contributions to the functioning of the EU internal market, and additional to ensuring a high level of public health protection. The global nature of the pharmaceuticals market is also distinctive which highlights the role of the EU as a global actor.
The COVID-19 pandemic has drawn particular attention to EU-level activity regarding the pharmaceutical sector, with the recent EU Pharmaceutical Strategy forming one aspect in the design of the European Health Union. The strategy encompasses the entire lifecycle of medicines, and is based on four pillars: ensuring access to affordable medicines for patients and addressing unmet medical needs; supporting competitiveness, innovation and sustainability of the EU’s pharmaceutical industry and the development of high-quality, safe, effective and greener medicines; enhancing crisis preparedness and response mechanisms, diversified and secure supply chains to address medicines shortage; and ensuring a strong EU voice in the world by promoting a high level of quality, efficacy and safety standards.
These issues are set to be addressed in the review of the current EU pharmaceutical legislation, but also engage with the diversity of themes arising in recent work in this multifaceted area, such as the fundamental value of health within an inclusive and equitable pharmaceutical strategy, the application of EU competition law to pharmaceuticals, the EU’s impact on access to medicines in low and middle-income countries, and the interplay of global standards and EU pharmaceutical regulation.
This panel brings together a timely range of perspectives to build on these considerations and discuss ongoing challenges.
